Prototek Digital Manufacturing LLC, its affiliates, and subsidiaries, (“Prototek,” “we,” “us,” or “our”) operate prototek.com and any other website that links to this Privacy Policy (each a “Site”) or by the products and services we offer through the Site (collectively, the “Services”). This Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your information when you use the Services and tells you about the privacy rights you may have available to you regarding your personal information. This Privacy Policy does not apply to any website or online service operated by a Prototek affiliate or subsidiary that has a separate privacy policy. 

Please carefully read this Privacy Policy as we may update it from time to time as indicated by the Last Updated date at the top of this page. By continuing to use the Services, you acknowledge and agree to the collection, disclosure, and use of information in accordance with this Privacy Policy, and that you accept the Terms of Use, which are hereby incorporated by reference. If you do not agree with any portion of this Privacy Policy, now or as updated by us, please immediately cease using our Services. 

Personal Information 

For the purposes of this Privacy Policy, “personal information” means any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual. Personal information does not include:

How We Use Personal Information 

Prototek may collect, use, disclose, and otherwise process personal information for the following business and commercial purposes: 

• Provide the Services you request and maintain the Site, including to improving our offerings, auditing, data analysis, or troubleshooting. We seek to improve our offerings and understand how you interact with the Services, such as operating and maintaining the safety, security, and integrity of the Services, databases, and other technology assets, as well as diagnosing technical and service problems. 

• Create, manage, and administer your account. When you register as a user of the Services, the personal information you provide can personalize the different functionalities of the Services that are available to you as a registered user. 

• Perform the development, compliance, and undertaking of your purchase of Services or of any other contract with us through the Services. 

• Communicate with you regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation and to market the Services to you through news, special offers, and general information about other goods, services, and events we offer that are similar to those that you have already purchased or enquired about. If you contact our customer services representatives, we will use data about you to help you resolve a problem or answer your question. 

• Protect and enforce our legal rights and otherwise comply with law, such as protecting the rights and property of individuals, employees, and Prototek, as well as preventing and investigating fraud, loss, abuse, illegal use, and other misuse or violations of our Terms of Use. We also will use data to comply with applicable law, such as proceedings, process, court orders, or governmental requests. 

• Personalize and understand your experience, such as your personal or professional interests, demographics, user experience with us, and contact preferences, as well as to customize offers to your interests.

Email Marketing: You may opt out of newsletters, marketing, promotional, or advertising emails by following the unsubscribe process included in any promotional email you received or by contacting us at [email protected]. Please keep in mind that if you opt out of receiving marketing messages, you will still receive transactional and service-related emails from us (such as emails related to your services, your account, correction of personal information, password reset requests, reminder emails you have requested, updates to our terms and policies and other similar communications essential to your transaction) that may be necessary for us to make the services available to you or respond to your inquiries.  

SMS Marketing (texts): We may provide you with promotional offers and other marketing communications by text message. You may opt in by indicating your preference in our online contact forms. If you agree to receive SMS communications from us, then we may send you information, including promotional or marketing text messages, to the phone number you provide. You may opt out of receiving text messages by replying “Stop” to any message you receive, or, to opt out of marketing or advertising calls, by contacting us through one of the methods specified in the Contact Us section below and sharing the phone number that you would like to opt out. 

Cookies and Other Web Technologies 

The Services use cookies and similar tracking technologies, such as beacons, tags, and scripts from third parties and service providers, to help personalize your online experience, maintain security, advertise our services to you, analyze your activity on the Services, and remember certain information. Cookies help us understand how users interact with our Services, including date and time of visits, pages viewed, amount of time spent using our digital offerings, or general information about the device used to access our Services. Information related to these actions and technologies are automatically transmitted by your browser to us. Through the use of cookies and other similar technologies, information about video materials or services you engage with on the Services may be disclosed incidentally in the ordinary course of business. 

We may also share information that we collect through these technologies with third parties, such as service providers, advertisers, and advertising companies as described in this Privacy Policy. Certain third-party content providers, advertisers, and advertising companies may also place cookies or other similar technologies on your computer or mobile device. 

Web beacons and pixels allow us to count users who have visited various pages on our Services. We may include web beacons in promotional email messages in order to determine whether messages have been opened and acted upon. Third parties may also deliver and use web beacons. While some may be used to support customizing advertising to you, others may be used to protect legal rights to content provided on our Services, such as protecting the copyright to a photograph or video. 

When you use social media platforms, applications, or tools that enable features like audio or video content (sometimes known as “plugins”), or other features that are operated or offered by third parties and are integrated into our Services or allow you to create an account on the Site and log in to use the Services through that third-party social media platform, such as Google, Facebook, and LinkedIn, we may collect information from those third parties. This may include payment services, login services, or review platforms. 

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some parts of our Service. Choices you make may be browser- and device-specific. In addition, your mobile device settings may allow you to limit your device from sharing certain information for advertising purposes. How We Disclose Personal Information 

We may disclose your personal information we collect or you provide us with in the following situations: 

• Service Providers that perform services on our behalf and for ordinary business purposes such as to monitor and analyze the use of our Services, to advertise on third-party websites to you after you visited our Services, for payment processing, and to contact you. Service Providers have access to your personal information only to perform their tasks on our behalf and are obligated not to disclose or use it for any other purpose.  

• Payment information is provided directly to our third-party payment processors whose use of your personal information is governed by their separate privacy policy. We require these payment processors to adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council. PCI-DSS requirements help ensure the secure handling of payment information. 

• Business Transfers in connection with, or during negotiations of, any merger, sale of Prototek assets, financing, or acquisition of all or a portion of our business to another company. By using our Site and providing your personal information, you consent to this transfer, provided use of the personal information will remain in accordance with this Privacy Policy in place at the time of the transfer. If required by law, we will separately notify you of such transfer. 

• Affiliates and Subsidiaries for business purposes, such as providing the Services and other offerings. 

• Business Partners and Other Third Parties to offer you certain products, services, or promotions and to protect the security and integrity of the Services and correct any technical problems and malfunctions. We may engage third parties to act as our service providers and perform certain tasks on our behalf including, but not limited to, analyzing customer data, providing marketing and targeted advertising assistance, financing, processing payments, and processing or storing data in connection with your use of our Services and delivering products to customers. 

• To comply with our legal obligations, such as where personal information requested by law enforcement agencies or if we are required to do so by law, treaty, regulation, subpoena, court order, or a government entity. We also may disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating any agreement with us.

Security of Personal Information 

The security of your personal information is important to us but remember that no method of transmission over the internet, or method of electronic storage, is 100% secure. We use commercially reasonable measures means to protect personal information, however we cannot guarantee that the personal information can be 100% secure. 

Prototek will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other information. 

It is your responsibility to maintain the privacy of the information you are transmitting to use or any account you maintain with us. Please keep all information and any usernames and passwords in a safe and secure place. 

Links to Other Websites 

Our Services may contain links to other websites that are not operated or controlled by us. These links are made available to you as a convenience, and you agree to use these links at your own risk. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the privacy policy of every site you visit. We have no control over and disclaim any responsibility for the content, privacy policies, or practices of any third-party sites or services. 

Children’s Privacy 

Our Services are not intended for anyone under the age of eighteen (18) and no one under the age of eighteen (18) may provide any personal information to the Services. We do not knowingly collect personal information from anyone under the age of eighteen (18). If you believe we might have collected personal information from a child under eighteen (18) inadvertently, please contact us using the information provided below.  

Notice to Individuals Outside the United States  

If you are located outside of the United States, any connection to the Services and any information you provide to us may be transferred to and/or stored on servers located in the United States and to countries in the world where our affiliates do business in connection with the uses identified above. U.S. State Privacy Laws  

Prototek processes your personal information in accordance with applicable U.S. state data privacy laws. Some state laws, such as the California Consumer Privacy Act (“CCPA”), permit residents to exercise certain rights regarding their personal information. Consistent with applicable law, residents of these states may exercise the rights described in this section. Please note that consumer rights vary from state-to-state and some states do not provide consumers all of the rights detailed below.  

Retention of Your Personal Information 

Prototek will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. 

The criteria used to determine our retention periods include:

Categories of Personal Information Disclosed and Categories of Recipients 

We disclose the following categories of personal information for a business purpose or commercial purpose: 

• We disclose Identifiers, Device, Internet and Network Activity, Commercial Information, Geolocation Information, and Inferences with businesses, service providers, and third parties, such as cloud hosting and internet service providers, government entities, operating systems and platforms, and product distributors. 

• We disclose Commercial Information with businesses and service providers who process payments. 

• We disclose Sensitive Personal Information and Education, Professional or Employment-related Information with government entities and in the event of civil litigation to comply with our legal obligations.  

Right to Access, Know, and Correct Personal information 

You may submit a request to access, know, and obtain from Prototek information regarding the personal information that has been processed in the past 12 months by Prototek and to correct any personal information maintained by Prototek. Once we receive your request and confirm your identity, we will disclose the following: 

• The categories of personal information collected. 

• The sources from which the personal information was collected. 

• The business or commercial purpose for collecting or selling the personal information. 

• If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: 

• Sales, identifying the personal information categories that each category of recipient purchased; and  

• Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Right to Opt Out of Sale/Sharing/Targeted Advertising  

You may have the right to ask Prototek not to “sell” or “share” your personal information to third parties.  

Our Services use cookies and other online tracking technologies that may be considered a “sale” / “sharing” under applicable law. We do not sell personal information. However, the service providers we partner with (for example, our advertising partners) may use technology on the Services that “sells” personal information as defined under applicable law. 

Categories of personal information disclosed that may be considered “sale” / “sharing” include, Identifiers, Device and network information, and Internet/Network Activity. 

Categories of third parties to whom personal information was disclosed that may be considered “sale”/ “sharing” include certain advertisers and marketing partners, data analytics providers, and social media networks. 

If you wish to opt out of the use of your personal information for interest-based advertising purposes and these potential sales as defined under applicable law, you may send your request to us at the information provided in the Contact Us section. 

The opt out will place a cookie on your computer that is unique to the browser you use to opt out. If you change browsers or delete the cookies saved by your browser, you will need to opt out again. 

Your mobile device may give you the ability to opt out of the use of information about the apps you use in order to serve you ads that are targeted to your interests. You can also stop the collection of location information from your mobile device by changing the preferences on the device. 

Residents of certain states may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use. 

Our Site does not respond to Do Not Track signals (“DNT”). However, some third-party websites do keep track of your browsing activities. If you are visiting such websites, you can set your preferences in your web browser to inform websites that you do not want to be tracked. You can enable or disable DNT by visiting the preferences or settings page of your web browser 

Right to Delete Personal information  

You may have the right to request the deletion of your personal information that have been collected in the past 12 months, subject to certain exceptions. Once we confirm your identity, we will review your request to understand if an exception applies to your request. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) and as permitted by applicable law. We will delete or deidentify personal information not subject to an exception from our records and will direct our service providers to take similar action. 

Non-Discrimination and Non-Retaliation 

We will not discriminate against you for exercising any of your rights. 

Exercising Your Data Protection Rights

Only you or your authorized agent may make a consumer request related to your personal information. 

Your request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include: 

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and 

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. 

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  

You do not need to create an account with us to submit a request. We will use personal information provided in the request only to verify the requestor’s identity or authority to make it.  

Right to Appeal 

Residents of certain states may have the right to appeal our decision with respect to a request. To appeal a decision, please contact us through the ways listed above or any method outlined in the decision.  

Authorized Agents 

If you use an authorized agent, you may provide a power of attorney executed pursuant to applicable law. If a power of attorney is not submitted, you will be required to provide the authorized agent signed permission to submit a request, verify your identity directly with us, and directly confirm with us that you provided the authorized agent permission to submit the request. If you’re an authorized agent making a request, you need to submit the following to the email address below in our contact information: 

• A copy of a power of attorney provided to you by the consumer pursuant to applicable law; or 

• Proof of signed permission along with a copy of your ID and have the consumer directly confirm with us that they provided you permission to submit the request by sending an email. 

Where required, we will acknowledge a consumer request within 10 days of receipt and Prototek will disclose and deliver the required information free of charge within 45 days of receiving your verifiable request. The time period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.  

Any disclosures we provide may only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. 

California’s Shine the Light Law 

Under California Civil Code Section 1798 (California’s Shine the Light law), California residents with an established business relationship with us can request information once a year about sharing their personal information with third parties for the third parties’ direct marketing purposes.

In your request, please attest to the fact that you are a California resident and provide a current California address for your response. 

Changes to This Privacy Policy 

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Services prior to the change becoming effective and update the Last Updated date at the top of this Privacy Policy.
